Do I Have to Maintain a Certain Distance From My Neighbour’s Balcony When Setting up My Gaezbo?

Mastertent® folding gazebos are mobile structures and not considered real buildings (they do not require a building permit or building permission). As a result, there are no rules to comply with and your gazebo can be installed at a very short distance from the boundary. However, this doesn’t exempt the owner from complying with municipal town planning regulations.

Remember that even in the absence of specific rules on distancing, your neighbour's right of view and sight must be respected. Despite being mobile, gazebos cannot excessively encroach on the privacy or access to light of another person's property.

Good neighbourly practices: Although legally permissible, installing a gazebo at a very short distance from the boundary could create tension with neighbours. We always recommend making your intentions clear and reaching an amicable agreement.
